What exactly is electronic disclosure?

Monday, March 15th, 2021

eDisclosure is best described by the component parts.

Electronic refers to the material held in electronic form, typically this will be emails and their attachments and the multitude of document files such as Word and Excel. It can also include social media content and the contents of devices such as phones and tablets such as messaging platforms. This is also referred to as ESI or electronically stored information.

The disclosure element is the process of identifying, collecting, processing, analysing, reviewing and presenting ESI in legal proceedings. This process is also referred to as the Electronic Discovery Reference Model (EDRM).
